We are a company registered in England and Wales under company number 10365995 and have our registered office at Gorcombe Farm (Top Barns), Thornicombe, Blandford, Dorset, DT11 9AG.

AfterJam offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. 

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

Products 

Our products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy. 

We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate. 

We reserve the right, but are not obligated, to limit the sales of our products to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected. 

Billing and Account Information 

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgement, appear to be placed by dealers, resellers or distributors. 

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

In no case shall AfterJam, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Severability 

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

If you buy goods on our website you agree to be legally bound by these Terms. When buying any goods you also agree to be legally bound by our Terms of Use, the Terms of Conditions of Sale and any documents referred to in them (together, the “Terms”).

These Terms are only available in English. No other languages will apply to these Terms. These documents form part of this contract as though set out in full here.

Placing an Order

Below we set out how a legally binding contract between you and us is made.

When placing an order on our website you undertake that any and all information given is accurate and complete.

Please read and check your order carefully before submitting it. However, if you need to correct your order or delivery address, please contact us immediately. We will do our best to make amendments prior to dispatch, but we cannot guarantee changes can be made once an order is processed.

All orders are subject to acceptance and product availability. Availability information for products is listed on each individual product description.

Once you have placed an order we will send you an email that confirms payment has been processed and that your order has been received, at which point a contract (that will be subject to these Terms) will come into existence between you and us (the “Confirmation Email”).  

We may contact you to say that we do not accept your order. This is typically for the following reasons:

the goods are unavailable

we cannot authorise your payment

you are not allowed to buy the goods from us

we are not allowed to sell the goods to you

you have ordered too many goods

there has been a mistake on the pricing or description of the goods.

A separate email will be sent to you confirming the dispatch of the item(s).

Prices and availability of goods are subject to change without notice. The advertised delivery charge will be added to your order value unless otherwise stated.

Payment & Taxes

We accept online payment in a secure environment by credit card, or debit card.. We currently accept Visa, Mastercard, Visa Delta, Maestro, Visa Electron and Solo.

We will do all that we reasonably can to ensure that all of the information you give us when paying for the goods is secure by using an encrypted secure payment mechanism. However, in the absence of negligence on our part we will not be legally responsible to you for any loss that you may suffer if a third party gains unauthorised access to any information that you give us.

Your credit card or debit card will only be charged when your order has been placed.

The price of goods is inclusive of VAT at the applicable rate and does not include the cost of delivering the goods.

Special Offers & Promotions

Unless otherwise stated, special offers cannot be used in conjunction with any other promotion nor are they valid for the purchase of sale items or gift vouchers.

If a promotion is valid only for orders over a certain amount, that amount does not include delivery or the cost of a gift box.

Promotional codes cannot be added into an order retrospectively. Nor can prices during sales periods be applied to previous purchases. Discounts are only applicable to in-stock items while supplies last and are subject to change. 

FREE GIFTS: If a free gift is added to orders over a certain amount and items are returned so that the order is under the threshold amount, that gift must be returned or it will be charged at the advertised amount. The same is true of any promotion governed by a spending threshold.

FREE DELIVERY: Unless otherwise stated, all free delivery and free returns promotions are limited to UK addresses. Free delivery applies to UK standard delivery only. 

Delivery

Stock permitting, all orders are usually dispatched within three working days of the order being accepted.

In the event that an item is temporarily out of stock, we will notify you of the delay and dispatch it as soon as it arrives.

We use DPD local to deliver our goods.

If something happens which is outside of our control and/or affects the estimated date of delivery, we will try to let you know of the revised estimated date for delivery of the goods.

Unless you and we agree otherwise, if we cannot deliver your goods within thirty (30) days, we will:

let you know

cancel your order

give you a refund

If nobody is available to take delivery, please contact us using the contact details at the top of this page.

You are responsible for the goods when delivery has taken place. In other words, the risk in the goods passes to you when you take possession of the goods.

The estimated date and time window for delivery of the goods is set out in the Confirmation Email. The delivery period stated within which you will receive your order is indicative and, unless otherwise stated, not guaranteed.

Goods will be sent to the address given by you in your order. Delivery of the goods will take place when we deliver them to the address that you gave to us.

If you are ordering more than one item, your goods may be sent to you in instalments if certain items are out of stock. In this case, you will only pay a single delivery charge.

If your delivery address is outside of the UK, you may be subject to import duties and taxes, which are levied once a shipment reaches your country. You must meet any additional charges for customs clearance. Please note, customs policies vary widely from country to country. We recommend you contact your local customs office for further information. Please note international shipments may be subject to cross-border inspections by customs authorities.

Returns Policy

The right to change your mind

You have 10 days after the day you (or someone you nominate) receives the goods, unless your goods are split into several deliveries over different days. In this case you have until 10 days after the day you (or someone you nominate) receives the last delivery to change your mind about the goods.

Returning products after ending the contract.

If you end the contract for any reason after products have been dispatched to you or you have received them, you must return them to us. You must email info@afterjamcollective.com for a return label if one does not arrive inside your parcel.

We will pay the costs of return if the products are faulty or mis-described; or a delay in delivery due to events outside our control or because you have a legal right to do so as a result of something we have done wrong. In all other circumstances (including where you are exercising your right to change your mind) you must pay the costs of return.

The return period during sale time is 10 days from delivery of the goods. Except in the circumstances set out above, please note that we reserve the right not to offer free returns or free delivery for any items purchased during sale periods. 

AfterJam cannot accept exchanges or returns of used or damaged items (except in the case of faulty Products).

AfterJam will not accept exchanges or refunds of products if the labels have been removed or tampered with. The removal of labels will void the warranty of the product. If you wish to return or exchange any items, the labels must remain intact.

Disputes

We will try to resolve any disputes with you quickly and efficiently if you are unhappy with the goods, our service to you, or any other matter. If you want to take court proceedings, the relevant courts of the United Kingdom will have exclusive jurisdiction in relation to this contract.

Third Party Rights

No one other than a party to this contract has any right to enforce any term of this contract.

Termination  

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. 

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. 

If in our sole judgement you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof). 

Entire Agreement  

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. 

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service). 

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party. 

Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the United Kingdom.

Here at AfterJam, we aim to provide an easy and enjoyable shopping experience whilst being committed to safeguarding and preserving the privacy of our customers.

www.afterjamcollective.com do not disclose buyers' information collected to third party’s other than when order details are processed as part of the order fulfilment.  Details of your address and the telephone number and email you have provided us will be shared with our courier partners, to provide you with a 1st class delivery service. In this case, the third party will not disclose any of the details to any other third party.

If you make a purchase with us you are accepting our terms and conditions and agreeing to receive occasional marketing material by email but you can have your name removed from our list by simply clicking on "unsubscribe" link within every email.

We keep a record of your account information in our database so we can recognize you as a customer. We also keep a record of your purchases and email correspondence so we can track any orders and correspondence you may have with our products or service.

We do not store credit card details nor do we share customer details with any 3rd parties.

GDPR Compliance:  In order to comply with the new European GDPR regulations, we (AfterJam Collective Ltd) hereby inform you that the following data is collected when using our site: 

Website Usage Data (anonymised): IP addresses, device information, access information, cookies, visit duration and tracking, mouse and swipe actions, are tracked. These services allow us to improve the user experience and optimise our online store.

Personal Information: When placing an order with us here at afterjamcollective.com, we do need to collect some personal information in order to physically get your order delivered to you. We collect the following information in order to fulfil your orders: First Name, Last Name, Email, Contact Phone Number, Shipping address and Billing address. This data is only ever shared to companies involved directly with delivering your order (our warehousing provider and courier companies). If you select to subscribe to our mailing list during the checkout process, then your First Name, Last Name and Email address will be added to our mailing list for marketing purposes (we use Klaviyo & Shopify to manage this). If you select to create an account on this website, you consent to the storage of your personal details (first name, last name, email, contact telephone number, shipping address and billing address) being stored by us in order to streamline your future shopping experience at afterjamcollective.com.

You can request for your account to be deleted at any time by contacting our Data Protection Officer below. If you would like to request access to your data, please contact our Data Protection Officer. 

Google Analytics & Google Ads (Google Inc.) We use Shopify Analytics to track the usage of our site and optimise our website user experience to prepare reports on its activities for our use.  

Klaviyo: We use Klaviyo for our email marketing, newsletter sign up forms, and from time to time for placing online adverts. If you select to subscribe to our mailing list at checkout, Klaviyo will collect and store your personal data (email, first name, last name, purchase activity) on our behalf for the above purposes. PayPal:  We use PayPal to process some ecommerce payments for this website.
